That is the heading of a section in a contract.

The contractor is allowed to use

... fri programvare som tilbys under alminnelig anerkjente fri programvare lisenser, og som etter en forsvarlig vurdering .... ikke krenker tredjeparts rettigheter.

Hvis fri programvare som benyttes ... krenker tredjeparts rettigheter, skal ... avhjelpe rettsmanglene i henhold til punkt XXX.

It is obviously related to infringements and violations, but I am not sure of the precise term.

I'm more than a little skeptical about "defect of title" here. That phrase has been borrowed from real property law. Most of the examples I now find in the software context are coming from German firms. It will be interesting to hear of any native English use in the U.K. or elsewhere. I've never seen it over here in this context.

There were some good explanations under lack of rights.

In the end I went for defect of title, as this was what a colleague had used in another document in the project - and his section was more concerned with software than mine!
