MAKA BERDASARKAN FAKTA-FAKTA, ALASAN HUKUM DAN BUKTI-BUKTI TERSEBUT DIATAS, PARA PENGGUGAT MOHON KEPADA MAJELIS HAKIM YANG TERHORMAT UNTUK MEMERIKSA DAN MEMUTUS SEBAGAI BERIKUT:

DALAM POKOK PERKARA:

1. Menerima Gugatan Penggugat untuk seluruhnya;
2. Menyatakan bahwa Tergugat telah melakukan perbuatan melawan hukum oleh karenanya Tergugat bertanggung jawab atas perbuatan melawan hukum tersebut;
3. Menghukum Tergugat untuk membayar ganti kerugian kepada Penggugat sejumlah USD455,000 (empat ratus lima puluh lima ribu Dolar Amerika Serikat) ditambah biaya melakukan perdamaian, dalam bentuk biaya panasehat hukum, senilai USD120,000 (seratus dua puluh ribu Dolar Amerika Serikat) berkaitan dengan Tuntutan I dan Tuntutan 2, ditambah bunga sebesar 0.5% (nol koma lima persen) per bulan sejak tanggal dimasukannya Gugatan ini sampai dengan tanggal dimana ganti kerugian tersebut dibayar secara penuh;

THEREFORE, BASED ON THE FOREGOING LEGAL FACTS, GROUNDS AND EVIDENCES, THE PLAINTIFFS APPEAL TO THE PANEL OF JUDGES HONORABLY TO EXAMINE AND DECIDE THE FOLLOWINGS:

IN THE SUBSTANCE OF THE CASE:

1. To receive the Plaintiff’s Lawsuit at whole;

2. To declare that the Defendant had committed tort and therefore the Defendant shall be responsible for the said tort.

3. To penalize the Defendant to pay indemnification to the Plaintiff amount of USD 455,000 (four hundred and fifty five thousand US Dollars) plus fee for reconciliation process in the form of attorney’s fee amounting to USD 120,000 (one hundred and twenty thousand US Dollars) in relation to the Claim 1 and Claim 2, plus interest 0.5% (zero point five per cent) per month since the filing date of this Lawsuit up to the date where the indemnification is fully paid;

4. To declare that the Defendant shall pay up to USD 73,907.06 (seventy three thousand nine hundred and seven US Dollars and six cents) plus attorney’s fee in term of the Plaintiff reconciles to the Co-Defendant VII and Co-Defendant VI;

FUNCTIONS OF THE SOLIDOSE

4.1. Main Functions

4.1.1. Dose

This is the default function at power up. The dose value is calculated from the charge measured by the electrometer and the calibration factor in the ADI module (for the Solidose 308, the calibration factor is stored internally). If no ADI module is connected. The measured charge is presented (except if User factor (not 308) function is enabled).
The charge value is internally calculated four times per second but the display is updated one per second. When you make exposure the dose value is either accumulated or reset, depending on the setting of the Reset mode function under the SET menu.

4.1.2. RATE

The dose rate value is calculated from the current measured by the electrometer and the calibration factor in the ADI module (for the Solidose 308, the calibration factor is stored internally). If no ADI module is connected, the measured current is presented (except if the User factor (not 308) function is enabled). The measured current is to be though of as a mean current during one second. The Solidose measures the incoming charge during a quarter of a second and divides that charge with the exact length of that time interval to get the mean current during that time interval. The mean value of four such calculations is then presented in the display every second, as a dose rate or a current value. During/after the exposure you can press the DOSE key to check the dose that has been accumulated since the last time you pressed RESET (or since the exposure started, depending on the Reset mode setting).
