Sie (insurance company)weisen daraufhin, dass Sie laut Vertrag nicht für die Kosten haften, die meinem Mandanten durch die Insolvenz der (name of bank)entstanden sind. ****Dieser Hinweis geht aber an der Sache vorbei.**** Vereinbarungsgemäß hatten Sie an die {name of bank] einerseits die regelmäßig einmal jährlich im Dezember fällige Auszahlung aus der Police Nr. XYZ in Höhe von EUR XYZ und andererseits an meinen Mandanten direkt aus der Police Nr. ABC die regelmäßigen Auszahlungen in Höhe von EUR ABC zu leisten.

Normally you would say "to miss the point", but in this formal context, I would say "However, this is not the issue here".

pointless=u.a. zwecklos, "Hinweis geht an der Sache vorbei, er ist somit zwecklos, dient nicht dem Zweck". Nevertheless, I prefer Ian's suggestion.
